Gerade in größeren Unternehmen ist die Personalbeschaffung häufig als eigener Funktionsbereich, der mit Fachleuten, z. T. mit Psychologen besetzt wird, aufgestellt. Eine erfolgreiche Personalauswahl ist kein Glücksfall, sondern das Ergebnis einer professionellen, effizienten Vorgehensweise, welche klare Schritte definiert, was getan werden muss, um eine freie Stelle schnell mit dem am Besten geeigneten Bewerber zu besetzen. Regelmäßig sind den Personalrekrutierern die in § 1 AGG genannten Benachteiligungsgründe nicht bekannt, nicht klar oder nicht abgrenzbar, so dass bei den überwiegend betriebswirtschaftlich denkenden und handelnden Personalrekrutierern mit dieser Arbeit vorhandene Ängste genommen, vor allem aber Möglichkeiten und Grenzen des AGG aufgezeigt werden sollen, um vorgelagert bereits den Personalbeschaffungsvorgang rechtssicher zu gestalten und das Haftungsrisiko für die Unternehmen zu reduzieren. Beleuchtet werden die Möglichkeiten und Einschränkungen bei der Wahl des Inhaltes und der Formulierung von Stellenausschreibungen welche das AGG bietet.
