Die Arbeitsgerichte entscheiden im Beschlußverfahren über kollektiv-rechtliche Streitigkeiten (Schwerpunkt: Betriebsverfassungsrecht). Angesichts der Bedeutung dieser Verfahren ist wichtig, wie der entscheidungserhebliche Sachverhalt gesammelt wird. Das Arbeitsgerichtsgesetz legt in 83 Abs. 1 Satz 1 die gerichtliche Sachverhaltserforschung von Amts wegen fest. Die vorliegende Arbeit weist nach, daß diese Vorschrift ein gesetzgeberischer Fehlgriff war. Die Prozeßbeteiligten sind seit der Gesetzesnovellierung 1979 weitestgehend berechtigt, über den Verfahrensgegenstand frei zu verfügen. Dem entspricht es, ihnen regelmäßig auch die Sachverhaltsermittlung zu überlassen. Das wird durch die widerstreitenden Interessen sichergestellt. Nur so kann das Beschlußverfahren in angemessener Zeit beendet werden. Zudem wird der Betriebsfrieden besser gewahrt als bei obrigkeitlicher Sachverhaltsaufklärung. Das öffentliche Interesse am Beschlußverfahren wird nicht beeinträchtigt.
