English summary: In this work, Thomas M. J. Mollers shows that the concepts of peace, the economy and law alone are no longer an adequate basis for the process of European unification. However the Member States of the E.U. do have enough power and enough in common to enable them to form a European identity beyond the level of legal technicalities and to join forces in coping with the future tasks which will confront them in the 21st century. Against this background, the author presents the first components of a European legislative theory and methodology. This is necessary if the function of the law in European integration is to become a means of regulating the many questions of cooperation in Europe but also of providing clarity in the implementation of European law at the national level. Along with increased openness and the further democratization of European institutions, a European legislative theory and methodology are those elements which are necessary to create a law which will be accepted by the citizens of Europe and will form the basis for a European identity. German description: In vielen Staaten Europas wird der Start in das 21. Jahrhundert teilnahmslos und mit einer gewissen Gleichgultigkeit und Lethargie hingenommen. Das liegt zum Teil daran, dass innerhalb der EG zwar Frieden und Wohlstand gesichert, ansonsten aber Wege und Ziele einer weiteren europaischen Integration ungeklart erscheinen. Die Betonung der nationalen Identitat einerseits und die Hoffnung auf die 'Vereinigten Staaten von Europa' andererseits bilden unuberbruckbare Gegensatze, die jeweils eine betrachtliche Eigendynamik entwickeln. Ein weiterer Faktor kommt hinzu: Obwohl in den letzten 40 Jahren die europaische Integration durch europaisches Recht umgesetzt wurde, existiert bis heute keine europaische Gesetzgebungs- und Methodenlehre auf europaischer oder nur auf nationaler Ebene.Thomas M.J. Mollers begrundet die europaische Idee und den kunftigen Weg einer europaischen Integration neu. Er zeigt, dass die Mitgliedstaaten der EU auf identitatsstiftenden Gemeinsamkeiten aufbauen konnen und genug Gestaltungsmacht besitzen, um an der Schwelle zum 21. Jahrhundert die anstehenden Zukunftsaufgaben gemeinsam zu bewaltigen. In diesem Rahmen werden erste Bausteine einer europaischen Gesetzgebungs- und Methodenlehre aufgezeigt. Dies ist notwendig, wenn sich das Recht im Rahmen der europaischen Integration zum 'Aktivposten' entwickeln soll. Im Zusammenspiel mit verstarkter Transparenz und weiterer Demokratisierung der europaischen Institutionen stellt eine europaische Gesetzgebungs- und Methodenlehre eine notwendige Bedingung uberzeugenden Rechts dar. Nur solches Recht kann vom europaischen Burger wirklich akzeptiert werden und die Grundlage fur eine Europaische Identitat bilden.
