English summary: Germany experienced multiple political and constitution changes between 1919 and 1989 and at each point, the core values of legal order were changed in revolutionary ways. Except for legislation, the law courts have considerable influence on all levels of administration and jurisprudence. The mastery of people over people exhibited in the democratic state of the constitution is thereby restricted through laws according to the basis of the separation of powers (Basic Law of the Federal Republic of Germany Art 20. Par. 3.) This state of legal and constitutional restriction applies to all, even to the bearers of state power. This question is made more complex when agents of the constitutional administration, especially the Federal Constitutional Court, themselves citizens, appear to harm the basic rights of all citizens. The author investigates, if the separation of powers, thus the intended union of justice to the constitution and to the law is really and lasting guaranteed or if the constitution is able to be subverted through an expansion of judicial power and can be changed through case-law. His conclusion: the unavoidable enhancement of the judicial development of the law in the region of legal gaps and loopholes has fomented a change of attitudes within the Supreme Court. The current positioning of case law suborns to a revolutionary excursion of the Supreme Court beyond the bounds of its legal competence. Unbounded courts are no empty danger but a frequent and plain to see reality. The duty of a court is to obey the constitution, not to change it. Der demokratische Rechtsstaat des Grundgesetzes ist darauf gerichtet, die Herrschaft von Menschen uber Menschen nach dem Grundsatz der Gewaltentrennung (Art. 20 Abs. 3) durch Gesetze zu begrenzen, die fur alle, auch fur alle Trager staatlicher Macht gelten. Dem sollten der Grundrechtskatalog und die Errichtung des Bundesverfassungsgerichts dienen, das von allen Burgerinnen und Burgern angerufen werden kann, wenn sie sich in ihren Grundrechten verletzt sehen. Der Autor untersucht, ob die Gewaltentrennung, also die gewollte Bindung der Justiz an die Verfassung und an die Gesetze real und dauerhaft gewahrleistet ist oder ob die Verfassung durch eine Ausweitung der Richtermacht unterlaufen und durch Richterrecht auaergesetzlich geandert werden kann. Sein Befund: Die unvermeidliche Steigerung richterlicher Rechtsfortbildungen im Bereich von Gesetzes- und Rechtslucken hat bei den Hochstgerichten einen Bewuatseinswandel bewirkt. Die standige Setzung von Richterrecht verleitet sie zu revolutionaren Ausflugen uber ihre Kompetenzgrenzen hinaus. Entgrenzte Gerichte sind keine bloae Gefahr, sondern nicht selten eine schlichte Realitat. Gerichte haben die Verfassung zu wahren, nicht zu verandern.
