Arbeitsbedingungen bedürfen einer ständigen Anpassung an die sich rasch verändernden Verhältnisse. Das deutsche Recht ermöglicht Veränderungen der Arbeitsbedingungen je nach ihrer Intensität durch das Weisungsrecht, durch Änderungsvereinbarungen, Änderungsvorbehalte oder die Änderungskündigung. Demgegenüber enthält das spanische Recht eine andere Konzeption: Zum einen steht dem Arbeitgeber die allgemeine Weisungsbefugnis zu. Zum anderen eröffnet Art. 41 des Estatuto de los Trabajadores (Arbeitnehmerstatut) dem Arbeitgeber die Möglichkeit, einseitig wesentliche Änderungen der Arbeitsbedingungen vorzunehmen. Der Arbeitnehmer hat diese Änderungen zunächst hinzunehmen und kann sich erst in der Folge dagegen wehren. Diese Arbeit untersucht die Voraussetzungen und das Verfahren der erweiterten Weisungsbefugnis sowie den Rechtsschutz gegen wesentliche Änderung der Arbeitsbedingungen. Besondere Bedeutung erlangt dabei die Analyse der Rechtsprechung des Tribunal Supremo. Zudem analysiert der Autor die wesentlichen Unterschiede zur Änderungskündigung nach deutschem Recht.
