English summary: The development and increasing spread of information and communication technologies has led to more and more automated forms of communication which can also be used for the formation of contracts. Andreas Wiebe examines the extent to which electronic business transactions can be adequately integrated into the present contract theory. In order to transcend the present state of technology and to make this study relevant for the future development of contract law, the author has included concepts from the theory of communication and has established a connection to the legal doctrine of the declaration of intent . German description: Die Entwicklung und zunehmende Verbreitung von Informations- und Kommunikationstechnologien fuhrt zu immer starker 'automatisierten' Formen der Kommunikation, die auch zum Abschluss von Vertragen genutzt werden. Es stellt sich daher die Frage, ob die bisherige Lehre zum Vertragsschluss auch den elektronischen Geschaftsverkehr angemessen integrieren kann. Damit die Untersuchung auch uber den derzeitigen Stand der Technik hinaus fur die zukunftige Entwicklung des Vertragsrechts von Nutzen sein kann, bezieht Andreas Wiebe kommunikationstheoretische Ansatze mit ein und stellt den Anschluss an die rechtsdogmatische Konzeption der Willenserklarung her. Diese Konzeption erweist sich als flexibel genug, auch automatisierten Kommunikationsvorgangen rechtliche Verbindlichkeit zuzuschreiben, wobei ein eigener Typus der 'elektronischen Willenserklarung' gebildet werden kann. Auch rechtsdogmatische Einzelprobleme rechtsgeschaftlicher Kommunikation werden behandelt und eine angemessene Verteilung verschiedener Risiken zwischen den Parteien gepruft. Dabei ergibt sich fur das Vertragsrecht eine Entwicklung vom Verschuldens- hin zum Risikoprinzip als Grundlage fur die Zuschreibung relevanten menschlichen Handelns, wobei der Vertrauensschutz als Wertungsgesichtspunkt starkere Bedeutung erlangt. Zugleich lassen sich Verantwortungsbereiche abgrenzen. Besondere Behandlung erfahrt der Verbraucher- bzw. 'Nutzerschutz', wobei die intensive Regelungstatigkeit des deutschen und europaischen Gesetzgebers in den letzten Jahren einbezogen wird. Die Ergebnisse der Untersuchung konnen eine Grundlage fur die Erfassung der zukunftig in zunehmenden Masse zu erwartenden 'Automatisierung' von Vertragsbeziehungen bilden.
