English summary: Sport means fun, entertainment, competition - and it also means business. The commercial value of sports broadcasting rights has increased significantly over the last couple of years. Sports coverage is no longer limited to the traditional media such as television and radio, but now also includes the new media. As a result of this development, the debate in Germany and the European Union as to whether sports coverage on the radio and in the new media should remain free and the extent to which it may be commercially exploited is becoming more intense. The example of the US sports market provides valuable guidance in this respect and shows the route that might be followed in Europe in the long run. Against this backdrop, the author undertakes a comparative study of the relevant issues of intellectual property, competition and antitrust law. The first part of his work provides the legal foundation for property rights in sports events; the second part focuses on the central marketing of sports broadcasting rights and analyzes recent decisions by the European Commission regarding the UEFA Champions League, the German Bundesliga and the English Premier League. German description: In zunehmendem Masse wird Sport als ein Wirtschaftsgut begriffen. Insbesondere im angloamerikanischen Rechtskreis ist die Kommerzialisierung des Sports im Vergleich zu Deutschland noch weiter vorangeschritten. Die jungste Auseinandersetzung um die Existenz von sogenannten Horfunkrechten hat diese Entwicklung deutlich vor Augen gefuhrt. Zunehmend gerat auch die Verwertung in den Neuen Medien in den Blickpunkt des Interesses.Inwieweit ist Sport ein gemeinfreies Gut und in welchem Umfang ist er fur die mediale Verwertung kommerzialisierbar? Matthias Laier untersucht diese Fragen rechtsvergleichend und verbindet dabei die Suche nach der Grundlage fur lizenzierbare Verwertungsrechte mit den kartellrechtlichen Fragen der Vermarktung. Am Beispiel der Horfunkrechte, der Ubertragung in den Neuen Medien und der reklamierten Rechte an Daten und Informationen uber Sportereignisse erortert er die entsprechenden Rechtspositionen und ihre Reichweite. Die Rechtsfragen kreisen dabei um Wertungen des Immaterialguter- und Wettbewerbsrechts. Matthias Laier greift den Anreizgedanken heraus und findet zu einem Ausgleich zwischen den Interessen des Sportveranstalters, der durch Arbeit und Investition eine vermarktungsfahige Leistung schafft nach bestmoglicher wirtschaftlicher Verwertung und den Interessen der Medien und der Offentlichkeit nach freiem Zugang. Anschliessend befasst sich der Autor mit den Schranken, die das Kartellrecht der Rechtevermarktung setzt. Dabei untersucht er die Auswirkungen der Zentralvermarktung fur die Vereine und den Marktzutritt neuer Medien und wurdigt vor diesem Hintergrund kritisch die jungsten Entscheidungen der Europaischen Kommission zur Vermarktung der UEFA Champions League, der Bundesliga und der englischen Premier League.
