English summary: The right to be heard is one of the essential guarantees in court proceedings granted by Article 103 I of the German Basic Law. Daniel Schnabl examines the new Section 321a, which was changed as of January 1, 2005 and provides an additional safeguard for the right to be heard in the German Code of Civil Procedure and in other procedural codes. Thus the significance of this topic transcends the code of civil procedure. The author gives detailed answers to legal and constitutional issues which are related to this new regulation. In conclusion, he examines whether or not the current version of Section 321a of the German Code of Civil Procedure is compatible with the rule of real legal protection which ensues from the general right to have recourse to a court. The author received an award from the Dr. Feldbausch-Stiftung for this thesis. German description: Daniel Schnabl untersucht den durch das Anhorungsrugengesetz mit Wirkung zum 01.01.2005 neu gefassten 321a ZPO. Das Anhorungsrugengesetz brachte nicht nur eine grundlegende Veranderung des 321a ZPO mit sich, sondern fugte daruber hinaus weithin wortgleiche Regelungen auch in die anderen Verfahrensordnungen ein. Daher reicht die Bedeutung der Thematik weit uber das Zivilprozessrecht hinaus. Der Autor beantwortet umfassend die mit der Neuregelung verbundenen einfachrechtlichen und verfassungsrechtlichen Fragen. Dabei geht es insbesondere um die Probleme, welche Entscheidungen mit der Anhorungsruge angegriffen werden konnen, wie der Begriff des rechtlichen Gehors im einfachrechtlichen Kontext zu verstehen ist, ob 321a ZPO auf andere Verfahrensgrundrechte analog angewendet werden kann bzw. muss und unter welchen Voraussetzungen eine Verletzung rechtlichen Gehors entscheidungserheblich ist. Daruber hinaus werden zahlreiche Fragen im Zusammenhang mit der subsidiaren Ausgestaltung der Anhorungsruge geklart. Des weiteren wird untersucht, inwieweit nach neuer Rechtslage noch Raum fur ausserordentliche Rechtsbehelfe besteht, inwieweit Dritte rugeberechtigt sind, wann die Rugefrist nach 321a II 1 ZPO beginnt und inwieweit eine Anhorung des Rugegegners erforderlich ist. Schliesslich widmet sich der Autor der Frage, ob die derzeit geltende Fassung des 321a ZPO mit dem aus dem allgemeinen Justizgewahrungsanspruch folgenden Gebot effektiven Rechtsschutzes vereinbar ist. Die Dissertation wurde 2006 mit dem Preis der Dr. Feldbausch-Stiftung ausgezeichnet.
