English summary: The state's participation in business life has resulted in a great deal of legal issues which in France are discussed using the term marches publiques and in Germany using the term public contracts. Due to the guidelines given in European law, there has been a change from a simple procedure of awarding contracts to a procedure which is influenced by the law on competition. This collection of articles contains the papers presented at the 12th German-French Jurists' Meeting in 2007, at which the problems in connection with this subject were discussed from the perspective of civil law, public law, competition law and criminal law. With contributions by: Jurgen Basedow, David Capitant, Meinrad Dreher, Laurence Idot, Peter Jung, Florian Linditch, Jost Pietzcker, Joachim Vogel, Willy Zimmer German description: In Frankreich wird unter dem Schlagwort marches publiques die Beteiligung des Staates am Wirtschaftsleben bereits seit langem diskutiert, wobei sich allerdings dieser Begriff mit dem deutschen des offentlichen Auftragswesens nicht genau deckt. In Deutschland hat dagegen erst aufgrund der jungeren europarechtlichen Vorgaben ein Bewusstseinswechsel vom in erster Linie haushaltsrechtlich gepragten Vergabewesen hin zum wettbewerbsrechtlich orientierten Vergaberecht stattgefunden. Heute bildet das Vergaberecht ein eigenstandiges Rechtsgebiet, in dem einerseits der wirtschaftlich sinnvolle Umgang mit offentlichen Mitteln ein wesentlicher Faktor ist, andererseits aber auch der Tatsache Rechnung getragen wird, dass der Staat aufgrund seiner Nachfragemacht ein Wirtschaftsteilnehmer ist, dessen Verhalten von ganz entscheidender Auswirkung auf den wirtschaftlichen Wettbewerb ist. In strafrechtlicher Hinsicht schliesslich hat die Korruptionsbekampfung eine herausragende Bedeutung.Beim 12. deutsch-franzosischen Juristentreffen der deutschen Gesellschaft fur Rechtsvergleichung und der franzosischen Societe de Legislation Comparee im Juni 2007 wurden in jeweils vier deutschen und vier franzosischen Referaten zivilrechtliche, wettbewerbsrechtliche, offentlich-rechtliche und strafrechtliche Aspekte des offentlichen Auftragswesens erortert. Im vorliegenden Sammelband werden samtliche Referate in deutscher Sprache veroffentlicht.
