English summary: Elena Barnert deals with a standard figure of argumentation in civil law, a figure which appears in many contexts: in the shape of a careful captain, a conscientious notary, a responsible insurance policy holder, an experienced truck driver, a respectable businessman, an attentive - or a cursory - reader, an objective spectator, a circumspect, sensible person, the reasonable man etc - figures which are significant for the structure of the adjudication process. Each of these variants is a complex normative model, a product of methodical fantasy, which has been constructed by judges for civil cases with the objective of creating a specific criterion for the implementation of the law. From a theoretical and practical perspective, the author analyzes the (judicially constituted) imaginary third man as the ideal player in law - selectively, but not arbitrarily equipped with varying characteristics. German description: Elena Barnert behandelt den richterlichen Rekurs auf einen objektiven, verstandigen oder sorgfaltigen Menschen. Dieser fiktive Massstabstrager, den der Zivilrichter etwa zur Beantwortung von Fahrlassigkeits- oder Auslegungsfragen entwirft und seiner Urteilsbegrundung zugrundelegt, wird als Dritter bezeichnet, weil er als 'idealer' Rechtsakteur zu den Prozessparteien hinzutritt. Er ist also ein Konstrukt, ein Produkt planmassiger Phantasie. Die Autorin untersucht den eingebildeten Dritten zunachst in abstracto, u.a. unter rechtsmethodologischem, ideengeschichtlichem und sprachwissenschaftlichem Aspekt. Anschliessend geht es - unter den Rubriken Handlung, Verstandnis, Wille und Gefuhl - darum, wann und wie der Zivilrichter mit Blick auf die besondere Materie des Rechtsfalles den spezifischen modellhaften Dritten formt und in concreto strategisch-rechtspraktisch einsetzt. Ein wesentlicher Gesichtspunkt bei der Konzeption des jeweils massgebenden Dritten ist Sinn und Zweck der streitrelevanten Normen: Der Dritte im Wettbewerbs- oder Kapitalmarktrecht beispielsweise ist kluger und informierter als der Dritte in originar verbraucherschutzrechtlichem Kontext, weil hier nur der Abgleich mit einer eher schlichten, dort nur die Anlehnung an eine eher kenntnisreiche Modellfigur zur Verwirklichung der (letztlich richterlich definierten) ratio legis verhelfen kann. Als typisierender Gradmesser ist der Dritte strukturell stets der gleiche; als dynamisches Kriterium mit fallentscheidender Kraft aber ist er eine Schablone fur Zuschreibungen unterschiedlichster Art - je nach Kontext, normativem Umfeld und avisiertem Resultat der Urteilsfindung.
