English summary: In this work, Claus Dieter Classen develops criteria to determine how democratic legitimacy can be ensured. His main idea is that these can only be established with the rule of law in mind, in particular the need to ensure that the proper decisions are made. In an international context, this is supervened by the principle of open statehood. It is the legislator's function to decide how this objective can be reached. The traditional idea that in the area of public administration this can best be ensured by its hierarchical structure has to be changed - and not only in regard to self-government. The author also discusses the legitimacy of international organizations as well as the application of foreign law in accordance with national conflict of laws provisions. German description: Claus Dieter Classen sucht die Kriterien fur das erforderliche Niveau demokratischer Legitimation naher zu bestimmen. Er folgt der Leitidee, dass diese nur mit Blick auch auf das Rechtsstaatsprinzip, konkret das Gebot der Sicherung moglichst sachgerechter Entscheidungen entwickelt werden konnen. Im internationalen Kontext kommt die offene Staatlichkeit hinzu. Wie dieses Ziel erreicht werden kann, muss primar der Gesetzgeber entscheiden. Die Konsequenz ist, dass die herkommliche Vorstellung, die demokratische Legitimation im Bereich der Verwaltung konne vor allem uber die hierarchisch organisierte Ministerialverwaltung sichergestellt werden, sich so als korrekturbedurftig erweist - und zwar nicht nur im Bereich der Selbstverwaltung, fur den sich das Bundesverfassungsgericht schon bislang grosszugig gezeigt hat. Vielmehr kann etwa auch im Ubrigen gesellschaftlicher Sachverstand in die staatliche Entscheidungsfindung einbezogen werden - ohne dass man deswegen, wie dies haufig geschieht, das Legitimationssubjekt, das als solches verfasste Staatsvolk, in Frage stellen muss. Mit Blick auf das Recht jenseits des Staates zeigt der Autor insbesondere, welche Bedeutung dem Demokratieprinzip mit Blick auf die Tatigkeit der europaischen und internationalen Organisationen zukommt. Zugleich behandelt er unter dem Blickwinkel demokratischer Legitimation bislang kaum erorterte Phanomene wie die innerstaatliche Anwendung von Volkergewohnheitsrecht nach Art. 25 Grundgesetz sowie von auslandischem Rechts gemass dem nationalen Kollisionsrecht.
