About the Book

The Dead Alive, also called John Jago's Ghost, is a novella written in 1874 by Wilkie Collins based on the Boorn Brothers murder case.It was reprinted with a side-by-side examination of the case by Rob Warden in 2005 by Northwestern Press. The Dead Alive was presented on Suspense March 9, 1953. The 30-minute adaptation starred Herbert Marshall. On the evidence of The Dead Alive, Scott Turow writes in his foreword that Wilkie Collins might well be the first author of a legal thriller. Here is the lawyer out of sorts with his profession; the legal process gone awry; even a touch of romance to soften the rigors of the law. And here, too, recast as fiction, is the United States' first documented wrongful conviction case. Side by side with the novel, this book presents the real-life legal thriller Collins used as his model-the story of two brothers, Jesse and Stephen Boorn, sentenced to death in Vermont in 1819 for the murder of their brother-in-law, and belatedly exonerated when their "victim" showed up alive and well in New Jersey in 1820.Rob Warden, one of the nation's most eloquent and effective advocates for the wrongly convicted, reconsiders the facts of the Boorn case for what they can tell us about the systemic flaws that produced this first known miscarriage of justice-flaws that continue to riddle our system of justice today. A tale of false confessions and jailhouse snitches, of evidence overlooked, and justice more blinkered than blind, the Boorns' story reminds us of the perennial nature of the errors at the heart of American jurisprudence-and of the need to question and correct a system that regularly condemns the innocent....William Wilkie Collins (8 January 1824 - 23 September 1889) was an English novelist, playwright, and short story writer, best known for The Woman in White (1859), No Name (1862), Armadale (1866) and The Moonstone (1868). The last has been called the first modern English detective novel. Born to the family of painter William Collins in London, he grew up in Italy and France, learning French and Italian. He began work as a clerk for a tea merchant. After his first novel, Antonina, appeared in 1850, he met Charles Dickens, who became a close friend and mentor. Some of Collins's works appeared first in Dickens's journals All the Year Round and Household Words and they collaborated on drama and fiction. Collins published his best known works in the 1860s, achieving financial stability and an international following. However, he began suffering from gout. Taking opium for the pain developed into an addiction. In the 1870s and 1880s the quality of his writing declined along with his health. Collins was critical of the institution of marriage: he split his time between Caroline Graves, except for a two-year separation, and his common-law wife Martha Rudd, with whom he had three children.
