English summary: Special private laws are characteristic of the German legal system. They conflict with the uniformity of the private legal order and the idea of equal individual freedom. Christoph Reymann analyzes the legitimacy of special private laws, using consumer and commercial law as examples. He illustrates the historical, terminological, systematic and methodological fundamentals of commercial and consumer law and examines the influence of the basic rights of the constitution and the market freedoms of the EU on their legitimacy. Based on the fundamental principles of equality and freedom, he concludes that certain guiding principles of the legal order which reflect either the attributes of the average consumer or the capabilities of the average businessman can serve as a rule to legitimate and control the separation of consumer law and commercial law from classic civil law. German description: Das deutsche Privatrecht ist dreigeteilt in das klassische BGB-Zivilrecht, das Sonderprivatrecht der Handelsvertrage und das Sonderprivatrecht der Verbrauchervertrage. Dies steht formal dem Gedanken der Einheit des Privatrechts entgegen und gerat mit der Idee der Gleichheit in Freiheit in Konflikt. Christoph Reymann sucht nach einem Erklarungsmodell und Revisionsansatz fur diese Dreiteilung. Er leitet die Untersuchung mit den rechtshistorischen Grundlagen, einer terminologischen Betrachtung des Begriffs der Sonderprivatrechte und der Herausarbeitung der Systemvorgaben, die von der Rechtsordnungsdichotomie in Privatrecht und Offentliches Recht und dem Postulat nach einer einheitlichen Wirtschaftsverfassung fur das Handels- und Verbraucherrecht ausgehen, ein. Zudem hinterfragt er ausgewahlte vertragstheoretische Modellansatze der Literatur und wirft den Gedanken auf, ob die Dreiteilung des Vertragsrechts der Rechtsordnung als Prinzip inharent ist. Nach der Uberprufung, ob die Drittwirkung oder die Schutzpflichten der Grundrechte bzw. Grundfreiheiten einen Legitimationsmassstab fur die Sonderprivatrechte der Handels- und Verbrauchervertrage bieten, formuliert der Autor ein Verbraucher- und Unternehmerleitbild als Legitimations- und Kontrollmassstab der freiheitlichen Ungleichbehandlung durch Sonderprivatrechte. An diese Prinzipienbildung schliesst sich die Uberprufung an, ob und inwiefern das einfachgesetzliche Handels- und Verbraucherrecht mit den vorgegebenen Personenbildern und den marktliberalisierenden Vorgaben der EG-Grundfreiheiten in Einklang stehen.
