About the Book

In der Debatte um ethische Probleme am Lebensende spielt die Frage von Patientenverf gungen eine wichtige Rolle. Sie gelten als ein Instrument, um die Autonomie von Patienten zu st rken, insbesondere das Selbstbestimmungsrecht von Todkranken und Sterbenden. Am 1. Juni 2006 ist das sterreichische Patientenverf gungsgesetz in Kraft getreten. Einerseits soll damit die Autonomie des Patienten gegen ber dem Arzt gest rkt werden, andererseits sollen der behandelnde Arzt und andere an der Behandlung Beteiligte klar und leicht erkennen k nnen, welche Bindungskraft und welche Folgen eine Patientenverf gung f r sie hat. Der praktische Nutzen sowie die ethische und rechtlichen Grenzen von Patientenverf gungen werden jedoch nach wie vor unterschiedlich beurteilt. Der vorliegende Band pr sentiert die Beitr ge der Jahrestagung 2006 des Instituts f r Ethik und Recht in der Medizin, Universit t Wien. Neben grunds tzlichen ethischen und rechtlichen Fragen befassen sich die Beitr ge auch mit praktischen Aspekten der Umsetzung des neuen Patientenverf gungsgesetzes, z.B. seine Anwendung f r ausl ndische Patienten, sozialrechtliche Aspekte, das Verh ltnis Patientenverf gung Vorsorgevollmacht sowie haftungsrechtliche Konsequenzen. Vergleichend zur neuen sterreichischen Regelung wird die Rechtslage in anderen L ndern, wie u.a. in Deutschland und den USA n her beleuchtet. Zuletzt werden sowohl die praktischen Auswirkungen f r den behandelnden Arzt als auch die Funktion der Patientenverf gung im Zusammenhang mit der Hospiz- und Palliativarbeit in sterreich er rtert.
