English summary: Against the background of a 1998 reform proposal of the German government as well as in the light of recent reforms of the private international law of torts in Italy, the UK and Switzerland, von Hein analyses from a comparative perspective the principle of the more favorable law that has dominated the German international law of torts for more than a hundred years. Instead of favoring the victim regardless of the type of tort in question, the author embraces the principle of proximity as the basis of the international law of torts, thus confining the more-favorable-law-principle to specific groups of cases in which objective reasons call for imposing upon the tortfeasor a standard of liability that is more severe than that in force at the place of injury. German description: Liegen der Handlungs- und der Erfolgsort einer unerlaubten Handlung in verschiedenen Staaten, wendet die deutsche Rechtsprechung das fur den Geschadigten gunstigere Recht an. Vor dem Hintergrund des Regierungsentwurfs eines Gesetzes zur Erganzung des Internationalen Privatrechts fur ausservertragliche Schuldverhaltnisse vom 24.8.1998 sowie jungerer Reformen des Internationalen Deliktsrechts in anderen europaischen Staaten geht Jan von Hein der Frage nach, ob und gegebenenfalls wie sich eine alternative Anknupfung in favorem laesi als Grundregel des Internationalen Deliktsrechts legitimieren lasst. Es zeigt sich, dass die alternative Anknupfung eine Durchbrechung des Prinzips der engsten Verbindung darstellt, die nur ausnahmsweise zulassig ist. Das Opfer wird grundsatzlich durch das Recht des Erfolgsortes hinreichend geschutzt, so dass die Anknupfung an den Handlungsort nicht ohne weiteres legitim ist, sondern eine belastende Haftungsverscharfung fur den Schadiger bildet, fur die eine auf den spezifischen Deliktstyp bezogene Begrundung gegeben werden muss.Diese Konzeption wird in Auseinandersetzung mit den dogmatischen und praktischen Problemen entwickelt und anhand ausgewahlter Distanzdelikte erprobt. Auch die prozessuale Umsetzung des Wahlrechts des Geschadigten wird genau untersucht.Zugleich leistet die Arbeit einen wichtigen Beitrag zu den Bemuhungen der Europaischen Union, ein Ubereinkommen uber das auf ausservertragliche Schuldverhaltnisse anwendbare Recht zu schaffen.
