Es setzt die Rahmenrichtlinie (RRL) 2000/78/EG des Rates vom 27.11.2000 zur Festlegung eines allgemeinen Rahmens für die Verwirklichung der Gleichbehandlung in Beschäftigung und Beruf um. Ziel des Gesetzes ist es, Benachteiligungen aus Gründen der Rasse oder wegen der ethnischen Herkunft, des Geschlechts, der Religion oder Weltanschauung, einer Behinderung, des Alters oder der sexuellen Identität zu verhindern oder zu beseitigen. Für das relativ junge AGG liegen seit dem 27.06.2007 erstmals seit Inkrafttreten aussagekräftige Zahlen über dessen Relevanz vor. Die Zahlen veröffentlichte das LAG Baden‐Württemberg (PM vom 27.06.2007, LAG Baden‐Württemberg, www.lag‐baden‐wuerttemberg.de), nachdem es für den Zeitraum 18.08.2006 bis 18.04.2007 bei den Arbeitsgerichten des Landes die Rechtsstreitigkeiten ermittelte, bei denen Normen aus dem AGG zur Anwendung kamen. Dies waren in dem relevanten Zeitraum von 9 Monaten insgesamt 109 Verfahren, wobei das häufigste Diskriminierungsmerkmal mit 36 % das Alter war. Dabei wurden die Diskriminierungen zu 36 % aus dem Bereich der Kündigungen und zu 26 % aus dem Bereich bestehender Arbeitsverhältnisse geltend gemacht; 38 % hatten einen Zusammenhang zu Bewerbungen. Die gewünschten Rechtsfolgen bestanden zu 75 % in der Geltendmachung einer Entschädigung oder eines Schadensersatzes.
