Este libro sobre el Caso CIDH Allan R. Brewer-Carías vs. Venezuela, es la reflexión personal del propio profesor Allan R. Brewer-Carías sobre la sentencia N° 277 dictada en su caso por la Corte Interamericana de Derechos Humanos el 26 de mayo de 2014, el cual fue llevado con la asistencia de los destacados abogados y profesores Pedro Nikken, Claudio Grossman, Juan E. Méndez, Douglas Cassel, Helio Bicudo y Héctor Faúndez Ledezma. En el mismo, se denunciaron las masivas violaciones cometidas contra sus derechos y garantías judiciales (a la defensa, a ser oído, a la presunción de inocencia, a ser juzgado por un juez imparcial e independiente, al debido proceso judicial, a seguir un juicio en libertad, a la protección judicial) y otros (a la honra, a la libertad de expresión, incluso al ejercer su profesión de abogado, a la seguridad personal y a la circulación y a la igualdad y no discriminación) reguladas y garantizados en la Constitución y en la Convención Americana de Derechos Humanos. Dichas violaciones se cometieron durante el curso del proceso penal desarrollado desde 2005 en Venezuela, con motivo de la falsa acusación formulada en su contra de haber "conspirado para cambiar violentamente la Constitución," con motivo de los hechos políticos ocurridos tres años antes, en 2002, con ocasión de la anunciada renuncia del Presidente Hugo Chávez, y en los cuales Brewer Carías se limitó a dar una opinión jurídica en ejercicio de su profesión de abogado, en esos momentos de crisis institucional. El juicio, en realidad, ha sido un instrumento de persecución política en su contra por su crítica al gobierno autoritario de su país. La Corte Interamericana, sin embargo, se abstuvo de juzgar el fondo de las denuncias, y admitió la excepción de falta de agotamiento de los recursos internos que había sido opuesta por el Estado, violando no sólo su propia jurisprudencia histórica sentada desde el caso Velásquez Rodríguez vs. Honduras (1987), que le imponía la obligación de entrar a conocer del fondo de la causa cuando las denuncias formuladas contra un Estado son precisamente violaciones a las garantías judiciales, particularmente al debido proceso y a la ausencia de autonomía e independencia judicial; sino violando también el derecho de Brewer de acceso a la Justicia internacional, protegiendo en cambio al Estado, e ignorando además, que en el proceso sí se había efectivamente agotado el único recurso disponible y oportuno que tuvo, que fue la solicitud de nulidad absoluta o amparo penal, que nunca fue resuelta.
