English summary: The German constitution requires the state ( Lander ) governments to implement federal legislative mandates under the supervision of the federal government. In addition, Article 104a of the 'Grundgesetz' provides that 'federal and state governments each bear the expenses resulting from their respective functions'. Court decisions have made it perfectly clear that Article 104a refers to executive rather than to legislative functions. Thus federal legislation ultimately places a heavy financial burden on the state governments, with the system of tax revenue equalization providing but little relief. Christian Heitsch analyzes the extent to which the state governments are entitled to set their own political priorities within the framework of both federal legislation and the federal government's supervisory directives. German description: Indem das Grundgesetz den Landern die Ausfuhrung der Bundesgesetze sowie des unmittelbar wirkenden Gemeinschaftsrechts zuweist, konstituiert es eine besondere Form der vertikalen Gewaltenteilung. Christian Heitsch arbeitet deren wesentliche Strukturen unter Berucksichtigung der Problemgeschichte deutscher foderaler Ordnung seit 1815 sowie unter Wurdigung des demokratischen und sozialen Charakters unseres heutigen Bundesstaats heraus. Dabei zeigt sich, dass die Ingerenzrechte, die der Bundesregierung im Bereich der Landeseigenverwaltung und der Bundesauftragsverwaltung zur Verfugung stehen, den Landern noch erheblichen Raum lassen, beim Vollzug der Bundesgesetze unterschiedliche Schwerpunkte zu setzen. Geltungsgrund der Bundestreue kann unter dem Grundgesetz weder das 'Wesen' des Bundesstaates sein, noch die Anknupfung an rechtsstaatliche Grundsatze, noch der offene oder verdeckte Ruckgriff auf das 'bundische Prinzip' der Verfassungsvertrage von 1867/1870. Vielmehr kommt nur die vorsichtige Erweiterung ausdrucklich normierter Informations-, Rucksichtnahme- und Mitwirkungspflichten in Betracht. Als Massstab richterlicher Streitentscheidung ist die Bundestreue daher strikt subsidiar. Unter Berucksichtigung politikwissenschaftlicher Erkenntnisse unterzieht der Autor die extensive Auslegung der Zustimmungsrechte des Bundesrats einer Grundsatzkritik. Nach systematischer Betrachtung aller Anwendungsfalle der Auftragsverwaltung kristallisieren sich zwei Varianten dieses Verwaltungstyps mit unterschiedlich weit reichenden Steuerungsbefugnissen der Bundesregierung heraus. Christian Heitsch kommt zu dem Ergebnis, dass die prinzipielle Anknupfung der Ausgabenlast an die Verwaltungskompetenz entgegen verbreiteter Kritik weiterhin sachgerecht ist, und dass die gegenseitige Haftung des Bundes und der Lander fur fehlerhafte Verwaltung eine wesentliche Schutzfunktion fur beide staatlichen Ebenen entfaltet.
