Die Arbeitsvertragsparteien können wirksam vereinbaren, dass der Arbeitnehmer über die vertragliche Mindestarbeitszeit hinaus Arbeit auf Abruf leisten muss. Mit der Vereinbarung von Arbeit auf Abruf, die über eine vertragliche Mindestarbeitszeit hinausgeht, verlagert der Arbeitgeber abweichend von § 615 BGB einen Teil seines Wirtschaftsrisikos auf den Arbeitnehmer. Bei der Angemessenheitsprüfung sind das Interesse des Arbeitgebers an einer Flexibilisierung der Arbeitszeitdauer und das Interesse des Arbeitnehmers an einer festen Regelung der Dauer der Arbeitszeit und der sich daraus ergebenden Arbeitsvergütung angemessen zum Ausgleich zu bringen Die bei einer Vereinbarung von Arbeit auf Abruf einseitig vom Arbeitgeber abrufbare Arbeit des Arbeitnehmers darf nicht mehr als 25% der vereinbarten wöchentlichen Mindestarbeitszeit betragen. Bei einer ergänzenden Vertragsauslegung ist darauf abzustellen, was die Parteien bei angemessener Abwägung ihrer Interessen nach Treu und Glauben als redliche Vertragsparteien vereinbart hätten, wenn sie die Unwirksamkeit der Klausel bedacht hätten. Zur Feststellung des mutmaßlichen Parteiwillens ist die tatsächliche Vertragsdurchführung von erheblicher Bedeutung. Sie gibt Aufschluss über das von den Parteien wirklich Gewollte. Ein Abrufarbeitsverhältnis i.S.d § 12 TzBfG liegt vor, wenn im Arbeitsvertrag die Dauer der Arbeitszeit nur auf einen bestimmten Zeitraum bezogen festgelegt wird und der Arbeitgeber nach billigem Ermessen entscheiden kann, wie viel Arbeit er zu welchem Zeitpunkt in Anspruch nehmen will.
